Terms of use
Updated: 2026-11-02
1. Legal notice
- Publisher: Isnadware — nightsy@isnadware.com
Nightsy is not affiliated with or endorsed by Airbnb, Booking.com or Abritel. Their names are used only to identify the platforms whose calendar you can import; they are trademarks of their owners.
2. The service
Nightsy adds up the nights a home is rented, from your listings' iCal links (Airbnb, Booking.com, Abritel) and the stays you enter. It warns you as a cap gets close, flags double bookings, and helps you organise cleaning and an arrival checklist. Using the app means you accept these terms.
3. A helper, not legal advice
Nightsy helps you track your nights. It replaces neither the regulations, nor your town hall, nor legal or tax advice.
- In France, renting out an entire primary residence is limited to 120 nights a year, or 90 nights if your town has decided so (law no. 2024-1039 of 19 November 2024). The cap the app suggests for a town is only a suggestion: you choose it and you check with your town hall which cap applies to your home, and any change to it.
- You state whether the home is your primary residence; Nightsy does not check it.
- You remain solely responsible for your declarations, your registration number, your taxes and complying with local rules, your lease and your building's rules.
- Alerts are an aid: a missing or late alert (phone off, notifications disabled, failed sync) does not mean you are under the cap.
4. Accuracy
The counter depends on the platforms' iCal exports and on what you enter: updated about every 3 hours, dates as published by the platform, history limited to recent months (older nights are entered by hand). Booking.com exports manual blocks as bookings: mark them "Blocked, not rented". A platform may also change or stop its export at any time. Regularly compare the figures with your platform statements, which prevail.
5. No account
Nightsy works without an account: your data is tied to your device. The subscription can be restored from the store on a new device, but homes and stays are not transferred automatically. Keep your own records: Nightsy is not an archive nor evidence against the authorities.
6. Free and Premium
The free version tracks one home. Premium adds several homes, among other things. Details and prices, taxes included, are shown in the app before purchase (for reference: €2.99 a month or €24.99 a year). Features may change; an essential Premium feature will not be removed during a period already paid for.
7. Subscription
- Payment is charged to your App Store or Google Play account when you confirm the purchase. Apple or Google collect the payment and issue the receipt.
- The subscription renews automatically for the same period unless cancelled at least 24 hours before the end of the current period.
- You manage and cancel it in your store account settings ("Manage my subscription" in the app). Cancellation takes effect at the end of the paid period. Deleting the app or your Nightsy account does not cancel the subscription.
- If the price goes up, the store tells you before the renewal and you can cancel.
- Right of withdrawal (EU consumers): you have 14 days after purchase. If you asked to use Premium straight away, the part of the service already provided may remain due. Refund requests go through Apple or Google, under their rules.
8. Legal guarantees
As a consumer, you benefit from the legal guarantee of conformity for digital services (French Consumer Code, articles L224-25-1 and following, and the equivalent law of your EU country). If something is wrong, write to us: we will fix the service within a reasonable time or, failing that, you can get a price reduction or end the contract.
9. Your commitments
- Only use the iCal links of your own listings or of listings you manage with their owner's consent.
- Tell the cleaner how Nightsy is used (cleaning page, the reports and photos you receive), and keep their page link secret.
- Do not send photos or notes showing or naming guests, or any unlawful content.
- Do not disrupt the service (massive automated requests, attempts to access other people's data, getting around the subscription).
In case of a serious breach, we may suspend the access concerned after warning you, except in an emergency (security, harm to others' rights).
10. Availability and liability
- The service is provided with care, but it may be interrupted (maintenance, outage, a platform or store being unavailable).
- The publisher is liable for its own faults under general law. It is not liable for the consequences of data supplied by booking platforms, of a wrongly chosen cap or residence status, of a lack of checking on your part, or for fines or penalties related to your own rental activity.
- If you use Nightsy for a business (concierge service, managing homes for others, company), the publisher's liability is limited to direct and foreseeable damage and, in total, to the amount you paid for Nightsy in the last 12 months.
- Nothing in these terms limits the rights the law gives consumers.
11. Intellectual property
The app, its texts, design and code belong to the publisher. You get a personal, non-exclusive right to use it for your own needs. Your data remains yours.
12. Apple and Google
These terms are between you and the publisher, not Apple or Google, who are not responsible for the app or its support. The terms of the store you downloaded the app from also apply; where they conflict on purchases and refunds, the store's terms prevail.
13. Personal data
See the privacy policy.
14. Stopping, and end of the service
You can stop at any time: "Delete my account" in Settings erases your data. Remember to cancel the subscription in the store too. If the publisher shuts Nightsy down, it will tell you at least 30 days ahead in the app and on this page, and will start no more renewals.
15. Changes
These terms may change; the date above is then updated. Important changes are announced in the app or on this page at least 30 days before they apply; you can cancel if you disagree.
16. Governing law and disputes
These terms are governed by French law; if you live in another EU country, you keep the protection of your country's law. If there is a problem, write to nightsy@isnadware.com first: we answer within 30 days. Failing agreement, the courts with jurisdiction are those set by law.
